PREAMBLE

The website lexip.co is published by PIXMINDS DISTRIBUTION, a company with share capital of €127,770, whose registered office is located in BARBERAZ, and registered under the unique identification number 425 010 451 RCS CHAMBERY.

PIXMINDS DISTRIBUTION is the author of the sales offer relating to the products presented on its website lexip.co. These General Terms and Conditions of Sale apply between PIXMINDS DISTRIBUTION and the customer of the website.

The General Terms and Conditions of Sale, together with the order form and the order confirmation, constitute the sales contract between the customer and PIXMINDS DISTRIBUTION relating to the sale of the ordered products. Unless otherwise agreed in advance and in writing by PIXMINDS DISTRIBUTION, its supplies are, as of right, subject to these General Terms and Conditions of Sale, which prevail over any other purchase or order conditions. All information contained on the lexip.co website (hereinafter referred to as the “Website”) is available in French, English, and German. The customer acknowledges that, prior to placing an order, they have read all the aforementioned information and the General Terms and Conditions of Sale. Consequently, placing an order implies the customer’s full and unconditional acceptance of these GTC. These terms are made available to the customer on the homepage of the PIXMINDS DISTRIBUTION website. PIXMINDS DISTRIBUTION reserves the right to amend the General Terms and Conditions of Sale at any time and without prior notice; such amendments shall apply to all orders placed after the amendment. Any use of the Website and any placement of an order for one or more product(s) through the Website implies unconditional acceptance of all the General Terms and Conditions of Sale. The General Terms and Conditions of Sale are reserved for consumer customers, to the exclusion of professionals. As a consumer, the customer therefore has specific rights, which would be called into question if the products purchased through the Website were in fact related to the customer’s professional activity.

Only persons legally capable of entering into contracts relating to the products offered for sale on the Website may place an order on the Website. When placing an order, the customer guarantees that they have full legal capacity to accept the General Terms and Conditions of Sale, place an order, and conclude a sale.

1 – PURPOSE

These General Terms and Conditions of Sale are intended to define the rights and obligations of the parties in connection with the distance sale of goods offered on the Website or through the Website’s customer service operated by PIXMINDS DISTRIBUTION.

2 – OFFER COVERAGE

The geographical coverage area of the PIXMINDS DISTRIBUTION online store offer is as follows: European Union, Great Britain, and Switzerland.

3 – CREATING AN ACCOUNT

To order products on the Website, the customer must create an account by providing the required information in the registration form.

For this purpose, the customer declares that they provide complete and accurate personal information enabling precise identification in any situation. Any fanciful or defamatory personal information may result in the closure of the customer account and the cancellation of the order.

When creating an account, the customer chooses a username and password and undertakes to keep them confidential.

This account may be accessed at any time by the customer using their credentials.

The customer is responsible for all actions carried out on the Website using their username and password. Any registered user will be bound by any order placed using their credentials, subject to the right of withdrawal in Article 16.

4 – CONTRACTUAL DOCUMENTS

The sales contract concluded between the parties is formed, in descending order of legal value, by the following documents:

  • The order form sent by the customer

  • The order confirmation sent by PIXMINDS DISTRIBUTION

5 – STOCK AND AVAILABILITY

Products offered on the Website are accompanied by an indicative availability time and delivery times. This information is updated regularly. A product indicated as “in stock” is available in PIXMINDS DISTRIBUTION’s own stock. Actual product availability may change quickly depending on sales on the Website or product stock levels.

6 – PLACING AN ORDER

The customer may place an order, in French, English, or German, directly on the Website after entering their credentials, in accordance with Article 3.

By browsing the various sections of the Website, the customer may place the products of their choice in their shopping cart by clicking the “Add to cart” button. At any time and until confirmation of the overall order, the customer may change their mind, adjust quantities, or cancel one or more selected products.

Each step required for the sale is detailed on the Website.

For any request for information or any order, the customer remains responsible for telecommunication costs when accessing the internet and using the Website, or when calling the Website’s customer service.

Pursuant to Article 1369-5 of the French Civil Code, the customer will have the possibility to review the details of their order and its total price and, where applicable, to correct or modify it before definitively confirming the order to express acceptance. PIXMINDS DISTRIBUTION cannot be held liable for data entry errors by the customer or their potential consequences in terms of delivery delay or delivery error. In such cases, any costs incurred for reshipment shall be borne by the customer.

Once the content of the shopping cart has been validated, the customer will confirm the order by:

  • Completing all requested information;

  • Declaring unconditional acceptance of all the General Terms and Conditions of Sale;

  • Validating by payment.

Validation of the order by the customer’s click constitutes acceptance of the prices and characteristics of the products purchased.

7 – ORDER CONFIRMATION

Once the order has been validated by the customer in accordance with Article 6, a confirmation email acknowledging receipt of the order and summarizing all information is sent by PIXMINDS DISTRIBUTION to the customer as soon as possible.

The order will be considered final only upon the sending by PIXMINDS DISTRIBUTION to the customer of the confirmation email referred to in Article 7, and the sale of the product(s) will be recorded only upon payment of the corresponding price by the customer.

If a product ordered by the customer is unavailable, in particular due to discontinued production, PIXMINDS DISTRIBUTION undertakes to inform the customer by email as soon as it becomes aware of such unavailability.

PIXMINDS DISTRIBUTION will then indicate, where applicable, the new timeframe under which the product will become available and will offer, if available, an equivalent product.

If the customer refuses to wait for availability of the product or refuses an equivalent product, the customer will be refunded for the price of the product if their bank account has been debited, within 14 days following confirmation of this refusal.

In accordance with Article L.122-1 of the French Consumer Code, PIXMINDS DISTRIBUTION is entitled to refuse any order for legitimate reasons, in particular in the event of a payment issue, foreseeable delivery difficulties, abnormal orders, or orders placed in bad faith. PIXMINDS DISTRIBUTION also reserves the right to request identity documents by email and/or by phone, in which case the customer may cancel the order.

8 – DURATION OF THE OFFER

Product and price offers are valid as long as they appear on the Website, it being specified that the Website is updated daily.

Product offers are subject to available stock. If a product becomes unavailable, notably due to being out of stock, PIXMINDS DISTRIBUTION undertakes to remove it from the Website as soon as possible.

9 – PRICE – INVOICE

Product prices displayed on the Website are shown in Euros including all taxes or in Pounds (£). The price guaranteed to the customer is the price displayed in Euros (€) on the PIXMINDS DISTRIBUTION Website at the time of the order.

The price set at the time of purchase is final. Product prices do not include delivery costs, which will be indicated to the customer either at the time of the order on the Website or during a call to customer service, before the customer validates the order. These costs are borne by the customer.

For deliveries outside France, the VAT provisions of the French General Tax Code will apply. Any change in the applicable rate may be reflected in the sale price of products in the catalogue.

For deliveries outside the European Union, the customer must pay customs duties, VAT, or other taxes due upon importation of the products into the country of delivery.

Any related formalities are also the exclusive responsibility of the customer unless otherwise indicated. The customer is solely responsible for checking the possibility of importing the ordered products under the law of the country of delivery.

An invoice will be issued by PIXMINDS DISTRIBUTION.

PIXMINDS DISTRIBUTION reserves the right to change prices at any time without prior notice; however, the applicable price for the customer’s order will remain the one indicated in the shopping cart summary when the order is validated. Prices displayed online or resulting from the order are guaranteed unless they prove, in particular due to an error or technical malfunction, computer bug, to be nominal or not in line with the actual selling price of the product.

10 – PAYMENT

Payment of the full price is due as soon as the customer confirms the order on the Website.

The customer undertakes to pay the stipulated price for the product ordered on the Website (product price and shipping) and also to pay or ensure payment, where applicable and directly to the forwarder or carrier, of customs duties, VAT, or other taxes due upon importation of products into the country of delivery.

The customer may pay for the order:

  • By PayPal

  • By Shop Pay

The customer guarantees to PIXMINDS DISTRIBUTION that they have the necessary authorizations to use this payment method when placing the order.

PIXMINDS DISTRIBUTION uses all necessary means to ensure the security and confidentiality of data transmitted on the Website (including online payment). For this purpose, the Website uses a remote payment system and SSL data encryption so that data is never transmitted in plain text over the network. In addition, the transaction is carried out via Société Générale’s e-transaction banking platform, which alone has the confidential information (card number, validity date) provided by the customer at the time of payment.

11 – FAILURE TO PAY – RETENTION OF TITLE

Ordered products remain the property of PIXMINDS DISTRIBUTION until full and final payment of their price, in accordance with Law No. 80-335 of 12 May 1980. PIXMINDS DISTRIBUTION reserves the right to reclaim the ordered products in the event of non-payment.

In such case, upon first request by PIXMINDS DISTRIBUTION, the customer undertakes to return any unpaid product, at their own expense.

12 – TRANSFER OF RISK

During the withdrawal period referred to in Article 16 below, the customer is responsible for the product as custodian. In the event of deterioration or destruction of the product while in the customer’s custody, the customer will bear all consequences (see Section 13: Delivery below).

13 – DELIVERY

As a general principle, delivery of products will take place, after the order payment is registered, to the delivery address indicated by the customer during the ordering process.

PIXMINDS DISTRIBUTION undertakes to deliver ordered items as soon as possible depending on the chosen delivery method and product availability. Delivery times indicated on the Website are average customary times and correspond to the total processing and shipping times.

The delivery time will be indicated to the customer during the ordering procedure, prior to validation of the order and before payment.

Products are delivered to the address indicated by the customer when ordering. The information provided by the customer when placing the order is binding: in the event of an error in the recipient’s details, the seller cannot be held responsible for the inability to deliver the product. In this case, any costs incurred for a new delivery will be borne by the customer and invoiced at actual cost.

When arranging a delivery appointment by phone with the carrier, the customer must expressly report any access or passage difficulties that delivery staff may encounter. The customer must measure access passages to their home in order to confirm to the carrier that the ordered product can be accessed.

The customer undertakes to be present on the delivery day agreed with the carrier and to check that the order is compliant upon receipt.

In the event of false information or incorrect measurements provided by the customer, additional costs related to the rental of lifts, storage, or return of goods will be borne exclusively by the customer.

All additional costs related to the rental of lifts, storage, or the customer’s absence, and the risk of damage resulting from these constraints, will be borne by the customer. A delivery service using a hoist through a window may be considered. This service will incur an additional charge which will be invoiced to the customer; upon request, a quote may be provided.

In case of late delivery, the customer may cancel the sale under the conditions provided for in Article L.138-1 of the French Consumer Code, provided that the observed delivery delay is not attributable to the customer, notably in the event of unavailability to receive the delivery.

The availability of the product is validated by the carrier’s tracking and control system.

Upon delivery, the customer must verify the content, conformity, and condition of the product(s). PIXMINDS DISTRIBUTION recommends that the customer check the content, conformity, and condition of the package(s) upon delivery and in the presence of the carrier. If the customer has any doubt whatsoever about the condition or content of the package, they must check the condition of the goods received and make precise, detailed, dated, and signed handwritten reservations as follows: on the delivery note provided by the carrier, in the presence of the delivery person. In all cases, the customer must notify PIXMINDS DISTRIBUTION by letter sent to PIXMINDS DISTRIBUTION, 45 Route d’Apremont, 73000 BARBERAZ, FRANCE. Verification of the delivered package is deemed to have been carried out and can no longer be contested once the customer or any authorized person who receives the package has signed the delivery note.

The liability of PIXMINDS DISTRIBUTION cannot under any circumstances be invoked.

In case the recipient is absent at the time of delivery, the carrier will leave a delivery notice at the delivery address indicated by the customer. Products must then be collected at the address and according to the terms indicated by the carrier.

If the products are not collected within the time limit set by the carrier, the Products will be returned to PIXMINDS DISTRIBUTION, which reserves the right to refund the price to the customer, with shipping costs remaining at the customer’s expense.

14 – FORCE MAJEURE

Cases of force majeure are expressly deemed to be those usually recognized by the case law of French courts and tribunals.

The occurrence of a force majeure event will, initially, automatically suspend performance of the order.

If, after a period of three (3) months, the parties note that the force majeure event persists, the order will be automatically cancelled, unless otherwise agreed by both parties.

15 – COMPLAINTS

Complaints regarding non-compliance of the delivered product(s) with the order must be submitted in writing directly to PIXMINDS DISTRIBUTION immediately upon receipt. The customer must keep the packaging and the delivery slip.

In the event of an error concerning the product, the customer undertakes to return the product(s) concerned as soon as possible to PIXMINDS DISTRIBUTION on the condition that they are returned without opening their packaging, in their original condition and packaging, with the accompanying documents. Return costs are borne by PIXMINDS DISTRIBUTION.

Upon receipt of the product in due form, PIXMINDS DISTRIBUTION will resend, at its own expense, the product initially ordered.

16 – RIGHT OF WITHDRAWAL

The customer has a right of return, at their own expense, within 14 business days (from receipt of the last item ordered in the case of a multiple order) from delivery of their order, for exchange or refund of products that do not suit them, in accordance with Article L.121-21 of the French Consumer Code.

If this period expires on a Saturday, Sunday, or public holiday/non-working day, it is extended to the next business day.

The returned product must be in its original condition and packaging. It must not have been used, nor suffered any deterioration, however minor, and must be perfectly clean. This right of withdrawal is exercised without penalties, except for return shipping costs.

Upon receipt of the product, the customer will be refunded the amounts paid, using the payment method used when ordering.

If the right of withdrawal is exercised for only part of the order, only the price charged for the returned products will be refunded.

In the event of partial withdrawal from the order, the customer who benefited from free delivery due to exceeding a certain order amount may be re-invoiced for delivery costs corresponding to the effective order, if that order falls below the free-delivery threshold.

By way of exception, the right of withdrawal may not be exercised for the contracts listed in Article L.121-21-8 of the French Consumer Code, including notably contracts for the supply of goods made to the consumer’s specifications or clearly personalized, or which by their nature cannot be returned or are liable to deteriorate or expire rapidly.

In accordance with applicable regulations, the right of withdrawal may also not be exercised for unsealed audio/video recordings or computer software, goods made to the customer’s specifications or personalized goods, and unsealed goods that cannot be returned for reasons of hygiene or health protection.

Products must be returned to PIXMINDS DISTRIBUTION at the following address: PIXMINDS DISTRIBUTION, 45 Route d’Apremont, 73000 BARBERAZ, FRANCE.

Products must be returned in their original packaging, properly protected. They must be in perfect resalable condition. Any product returned incomplete, damaged, washed, deteriorated, soiled, even partially, will not be refunded or exchanged.

The customer returns the products. We recommend keeping proof of postage to facilitate procedures in case any issue occurs during transport.

Except in cases of non-compliance or hidden defects, return costs are borne by the customer.

17 – WARRANTY

The information and descriptions provided for each product sheet, including photographs, technical characteristics, and description, are communicated by PIXMINDS DISTRIBUTION.

In accordance with Article L.111-1 of the French Consumer Code, PIXMINDS DISTRIBUTION aims to inform the customer and enable them to understand the essential characteristics of the product.

Before dispatch, the products delivered to the customer are checked to ensure their conformity with the description provided on the Website.

However, it is specified that for technical reasons (photographic and IT-related), the actual rendering of products may sometimes differ slightly from the photographs presented on the Website.

Without prejudice to any specific warranty conditions applicable to the product concerned, the products presented on the Website are subject to the following legal warranties.

Under Article L.217-4 of the French Consumer Code: “The seller must deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for lack of conformity resulting from packaging, assembly instructions, or installation when this is the seller’s responsibility under the contract or has been carried out under the seller’s responsibility.”

Under Article L.217-5 of the French Consumer Code: “Goods are in conformity with the contract:

If they are fit for the use normally expected of similar goods and, where applicable:

  • if they correspond to the description given by the seller and have the qualities presented to the buyer in the form of a sample or model;

  • if they have the qualities a buyer may legitimately expect having regard to public statements made by the seller, the producer, or their representative, particularly in advertising or labelling;
    Or if they have the characteristics agreed upon by the parties or are fit for any special purpose sought by the buyer, made known to the seller and accepted by the seller.”

Under Article L.217-12 of the French Consumer Code: “Any action resulting from lack of conformity is time-barred two years from delivery of the goods.”

Under Article L.217-16 of the French Consumer Code: “When the buyer asks the seller, during the course of the commercial warranty granted upon acquisition or repair of movable goods, for repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the buyer’s request for intervention or from the goods being made available for repair, if later than the request.”

Under Article 1641 of the French Civil Code: “The seller is bound by the warranty against hidden defects in the sold item which render it unfit for its intended use, or which so impair that use that the buyer would not have purchased it, or would have paid a lower price, had they known.”

Under Article 1648 paragraph 1 of the French Civil Code: “An action resulting from redhibitory defects must be brought by the buyer within two years of discovery of the defect.”

The consumer has two years from delivery of the goods to invoke the legal warranty of conformity in the event a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.

The legal warranty of conformity entitles the consumer to repair or replacement of the goods, free of charge and without major inconvenience.

If goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

The consumer may obtain a reduction of the purchase price while keeping the goods or terminate the contract for a full refund against return of the goods if:

  • the professional refuses to repair or replace the goods;

  • repair or replacement causes a major inconvenience to the consumer;

  • the non-conformity persists despite an unsuccessful attempt to bring the goods into conformity.

The consumer is not entitled to cancel the sale if the lack of conformity is minor.

Any period during which the goods are immobilized for repair or replacement suspends the warranty remaining until the repaired goods are delivered.

The rights mentioned above result from application of Articles L.217-1 to L.217-32 of the French Consumer Code.

The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code for a period of two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept or a full refund against return of the goods.

To invoke the legal warranty of conformity, customers must contact customer support (support@lexip.co) to request application of the legal warranty of conformity. Proof of purchase must be provided for the request to be valid. The relevant products must be sent by post in packaging suitable for safe transport. Products must be returned in the condition in which they were received with all elements (accessories, manuals, disclaimer, etc.). Return shipping costs will be reimbursed based on the invoiced rate upon presentation of supporting documents.

18 – CONDITIONS FOR USING PRODUCTS

Before any order and any use of products, the customer must read all information provided on the Website, learn about the characteristics and components of the products, and ensure they are compatible with the intended use.

The customer undertakes to systematically follow the usage advice provided by the manufacturer on the packaging and in the user manual before any use. For any additional information regarding product characteristics, customer service is available.

19 – PERSONAL DATA

The personal information requested from the customer is essential for processing and shipping orders, issuing invoices, and any warranty contracts. For these purposes, such information may be communicated to PIXMINDS DISTRIBUTION’s contractual partners. PIXMINDS DISTRIBUTION may also disclose this data to comply with an injunction from judicial or administrative authorities.

The customer may object to such disclosure and, in accordance with the “Data Protection and Freedoms” law (Law of 6 January 1978), has the right to access, modify, rectify, and delete data concerning them by contacting PIXMINDS DISTRIBUTION, 45 Route d’Apremont, 73000 BAREBRAZ, France, or via the Website’s “contact” form.

For fraud limitation reasons, PIXMINDS DISTRIBUTION may request supporting documents (identity, proof of address, etc.). PIXMINDS DISTRIBUTION thanks the customer for their understanding.

The Website is designed to be particularly attentive to customer needs. Cookies are used for the purpose of recording the customer’s visit to the Website in connection with building the shopping cart.

The customer may object to the storage of these cookies on their computer’s hard drive by configuring their browser.

In order to meet customer needs and ensure optimal distance service, PIXMINDS DISTRIBUTION may record certain personal data (last name, first name, address). PIXMINDS DISTRIBUTION undertakes to respect the confidentiality of personal data communicated by customers on the Website and to process it in accordance with the Data Protection and Freedoms law of 6 January 1978, as amended and currently in force.

20 – SUSPENSION – TERMINATION

The customer may terminate, at any time, their registration on the Website and close their account by sending a termination request to customer service.

In the event the customer fails to comply with any contractual obligations, notably in the event of a payment incident, PIXMINDS DISTRIBUTION reserves the right to suspend the customer’s access to the Website and PIXMINDS DISTRIBUTION services, or terminate the account depending on the severity of the breach. PIXMINDS DISTRIBUTION also reserves the right to refuse any order from a customer with whom there is any dispute.

21 – ELECTRONIC SIGNATURE

The “validation click” constitutes an electronic signature.

This electronic signature has the same value between the parties as a handwritten signature.

22 – EVIDENCE

Computerized records stored in PIXMINDS DISTRIBUTION’s IT systems under reasonable security conditions will be considered proof of communications, orders, and payments between the parties.

Order forms and invoices are archived on a reliable and durable medium that may be produced as evidence.

It is expressly agreed that PIXMINDS DISTRIBUTION and the customer may communicate electronically or by phone. Technical security measures are implemented to ensure the confidentiality of exchanged data.

PIXMINDS DISTRIBUTION and the customer agree that emails exchanged between them validly prove the content of their exchanges and, where applicable, their commitments, notably regarding transmission and acceptance of orders.

23 – INTELLECTUAL PROPERTY

PIXMINDS DISTRIBUTION holds intellectual property rights on the Website, composed of elements such as sounds, images, photographs, videos, writings, animations, programs, graphic charter, utilities, databases, software, and other underlying technology, as well as the right to distribute the elements appearing in the Website’s catalogue, in particular the photographs for which it has obtained the necessary authorizations from the persons concerned.

Consequently, any partial or total reproduction, on any medium whatsoever, of the elements making up the Website and the catalogue, their use, and their making available to third parties are strictly prohibited.

Without any solicitation on its part, PIXMINDS DISTRIBUTION prohibits the placement of any hyperlink to the Website. A customer wishing to place a link on their personal website directly to the Website homepage must first obtain the express authorization of PIXMINDS DISTRIBUTION.

24 – ENTIRE AGREEMENT

These General Terms and Conditions of Sale express the entirety of the parties’ obligations.

No other general or specific condition communicated by the customer may be incorporated into or derogate from these General Terms and Conditions.

25 – NO WAIVER

PIXMINDS DISTRIBUTION’s failure to invoke a breach by the customer of any obligation shall not be interpreted as a waiver of the obligation concerned or of the right to invoke such breach later.

26 – SEVERABILITY

If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation, or following a final decision of a competent court, the other provisions shall remain in full force and effect.

27 – LIABILITY

Products presented on the Website comply with French legislation in force and the standards applicable in France.

PIXMINDS DISTRIBUTION undertakes exclusively to comply with legal provisions applicable in France. No regulation specific to the country of delivery and/or of consultation of the Website may be asserted against PIXMINDS DISTRIBUTION.

The customer is solely responsible for compliance with regulations applicable in their country of residence or the destination country. It is the customer’s responsibility to inquire with the relevant local authorities about any import, export, or usage restrictions applicable to products they intend to order on the Website.

The service provided by PIXMINDS DISTRIBUTION is limited to supplying products under the conditions described in the General Terms and Conditions of Sale. PIXMINDS DISTRIBUTION cannot under any circumstances be held liable for advice, recommendations, or conditions of use provided by manufacturers on the Website or in their user manuals.

PIXMINDS DISTRIBUTION’s liability is limited to direct and foreseeable damage that may result from the customer’s use of the Website and products. PIXMINDS DISTRIBUTION is not liable for damage resulting from the customer’s fault in the use of the products.

PIXMINDS DISTRIBUTION cannot be held liable if failure or improper performance of its obligations is attributable to the customer, an unforeseeable and unavoidable act of a third party unrelated to product delivery, or a force majeure event that is unforeseeable, irresistible, and external.

More generally, PIXMINDS DISTRIBUTION cannot under any circumstances incur liability for indirect or unforeseeable damage occurring in connection with use of the Website and ordering products.

PIXMINDS DISTRIBUTION cannot be held liable for content available on other websites or internet sources accessible via hyperlinks inserted on the Website (including advertisements, products, services, or any other information), nor for damage of any kind suffered by the customer during a visit to such sites.

28 – DISPUTES

These General Terms and Conditions of Sale are governed by French law. Only the French version of these General Terms and Conditions of Sale shall prevail.

In the event of any difficulty arising in connection with the order, delivery of products, and more generally performance of the sale, the customer may, before any legal action, seek an amicable solution, notably with the help of a consumer association or any other advisor of their choice.


Appendix 1 – French Consumer Code & Civil Code

Article L211-4 of the French Consumer Code

“The seller must deliver goods in conformity with the contract and is liable for lack of conformity existing at the time of delivery.
